Terms of service

The service

Runciter provides Prudence, software for recording and maintaining data protection documentation. Prudence supports the accountability obligation in Article 5(2). It does not provide legal advice and does not certify compliance with Regulation (EU) 2016/679 or any other law.

Accounts and organisations

An account belongs to a person. A register belongs to an organisation. The organisation decides who is invited and what role each member holds, and is responsible for removing members who should no longer have access.

Customer content

The customer retains all rights in the records it enters and is responsible for their accuracy and for the lawfulness of entering them. Runciter processes those records only to provide the service, as described in the privacy notice.

Acceptable use

Prudence must not be used to store the personal data of individual data subjects beyond the pseudonymous references the product is designed around. Attempts to reach the register of another organisation or to circumvent access controls are prohibited.

Subscriptions and payment

Subscriptions are billed in advance in euro, excluding VAT, for the period stated at purchase. A subscription continues until cancelled and cancellation takes effect at the end of the current period.

Availability and support

Runciter operates the service on a continuous basis and gives reasonable notice of planned maintenance. Uninterrupted availability is not guaranteed.

Termination and export

A subscription may be ended at any time. The register remains exportable until access ends. After a defined wind-down period the data is deleted.

Document licence

The subscription includes a licence to the Prudence document set. The customer may rebrand each document, adopt it as internal policy, and present it to auditors, customers and supervisory authorities as its own documentation. The licence over documents already adopted survives the end of the subscription. Redistribution of the document set as a competing product is not permitted.

Proprietary models and frameworks

The compliance models on which Prudence is built are proprietary to Runciter. This includes the structure of the registers and the relationships between them, the lifecycle stages and the conditions that gate them, the rules by which gaps and warnings are determined from the regulation, the readiness measures, and the drafting of the document set.

The licence granted to the customer is a licence to use the service and to adopt its documents as its own. It conveys no right to reproduce, adapt or reimplement those models, in software or otherwise, as a product or service offered to others. Copying or replicating the system, in whole or in substantial part, is a breach of these terms and may be pursued as infringement of copyright, database rights and trade secrets.

Governing law

These terms are governed by the law of the European Union member state in which Runciter is established, and disputes are subject to the courts of that state.
